(hereafter: Visa JobCanada) commits to respect the private life of the persons registered on its Web site as users searching for employment (hereafter: " Job seeker"). The Policycontains rules related to the collection of personal information, the consent of the Job seeker, the use, the communication and the conservation of the personal information of the Job seeker as well as the access rights to his personal information and their changes. 
 
Before subscribing to the Web site of EstrieEmploi.ca, the Job seeker has to accept the present Policy and agree with its rules and obligations.
 
If the Web site of Visa JobCanada contains links to other Web sites on which Visa JobCanada has no control, Visa JobCanada refuses to be held responsible for the policies and practices related to the personal information of these other Web sites. Visa JobCanada suggests to the Job seekers to examine accurately the policies related to personal information of these others Web sites. 
 
The present Policy applies only to the personal information which Visa JobCanada collects, uses, communicates and conserves about its Job seekers.
 
COLLECTION OF personal information
 
 
Visa JobCanada is a company offering an on-line matching, recruitment and hiring service for Job seekers.
 
In relation to the services offered, Visa JobCanada asks the Job seeker, who has agreed with the Policy, to provide personal information, by filling out his on-line questionnaire, his resumé and by the registration of a video so that these informations can be transmitted to employers recruiting personnel for their company (hereafter: "Employers") and to recruiters in search of candidates to fill in employment opportunity with third parties (hereafter: "Recruiters").
 
Visa JobCanada can also conduct on-line surveys to better understand the needs, the profiles and the experience of its Job seekers or its visitors. The Job seeker or the visitor will be given the option to participate in such surveys. All the personal information given out by the Job seeker or the visitor in these surveys will be used on an aggregated basis for the compilation of data coming from such surveys and will not be kept. 
 
Visa JobCanada may also keep on files proofs of communication or correspondence with a Job seeker. Visa JobCanadawill use the personal information provided only to respond to the electronic mail (hereafter: “ E-mail”).
 
For data entry purposes, Visa JobCanada can also keep some information concerning the use of a Job seeker of its Web site such as the visited sections and the services, the computer hardware and the used software, including the IP address, the type of navigator, the name of domain, dates and hours of access and Web sites address that brought him to the Web site of Visa JobCanada as well as the links towards other Web sites used through out its own site. These data may be kept by Visa JobCanada to estimate the Web site performance, for security reasons of its Web site and for law purposes.
 
Collection of personal information
 
The following personal information constitute essential information to meet the Purposes and objectives of Visa JobCanada mentioned above, namely Job seeker’s personal information (family name and first name, complete address including zip code, phone number (residence and/or other), E-mail and spoken and written languages), working experiences (employer’s name, complete addresses including zip codes, phone numbers, occupations, titles, professions), schooling (name of the program, name of the school, complete address including zip codes) and professional and/or personal references (name of the person giving references, name of the company for which the person gives the references, phone number and/or E-mail).
 
All user authorizes Visa JobCanada to validate, modifie or remove all personal information which it does not wish other user to see (ex: CV and company's description, etc).
  
Personal information Accuracy
 
The personal information provided by the Job seeker must be accurate, complete and up-to-date in order to avoid the transmission of inappropriate personal information to Employers and Recruiters. In other words, if the personal information provided by the Job seeker need to be updated, he has the responsibility to edit them by reaching the options button in his account on Visa JobCanada (hereafter: "Account"). Afterwards, Visa JobCanada commits to display accurately the new personal information modified by the Job seeker on its Web site.
 
 
Furthermore, the Job seeker will be able to delete its personal information and, or, his resumé at any time by reaching the options button in his Account. As soon as the Job seeker delete the totality of his Account, all the copies of his resumé, all its personal information and all information of the profile of his Account will then be deleted, except for an inaccessible archival copy via the Web site of Visa JobCanada and copies already sent to Employers and Recruiters having paid their access rights or amongst those that the Job seeker will have sought by himself for employment. By deleting the totality of the Account, the Job seeker will lose all the access rights to his Account.
 
Job seeker’s consent
 
Obtaining the Job seeker’s consent
 
As soon as the Job seeker agrees to the present Policy by clicking on the button " I ACCEPT " there will be collection, utilization, communication and conservation of the personal information given out by the Job seeker by Visa JobCanada in accordance with the Purposes and objectives mentioned above.
 
The Job seeker accepts by the present policy that as soon as Visa JobCanada will receive his consent to the Policy, the company will divulge the personal information of the Job seeker to Employers and Recruiters. In other terms, the Job seeker has to expect reasonably that his personal information is, during his subscription, sent to Employers and Recruiters, and that Visa JobCanada exempts itself from the use that they will make of the personal information. If the Job seeker agrees to the Policy by clicking on the button " I ACCEPT " hereafter, there will be presumption that he has accepted the Purposes and objectives mentioned above, that he has understood the reasonable respect waits of private life from which he benefits and that he exempts Visa JobCanada from all responsibility related to the use of his personal information in conformity with the present Policy.
 
Limitation of obtaining the Job seeker’s consent
 
The Job seeker consents by the present Policy as to which, in certain circumstances, Visa JobCanada can collect, use, communicate and conserve his personal information without his consent, notably for legal purposes, such as the control and the application of the law, the detection of a fraud or for security reasons. 
 
Consent’s revocation
 
Job seeker will be able to revoke his consent to the Policy at any time by reaching the options button in his Account. In this case, the Job seeker will lose all his access rights to his Account and all his personal information will be deleted such as mentioned above in the paragraph Personal information deletion.

Conditions
 
Visa JobCanada commits to use, communicate and conserve the Job seeker personal information and video according to the Purposes and objectives of the present Policy and, or according to the current law at the time of their use, communication and conservation. 
 
It is understood that Visa JobCanada is untitled to use the Job seeker personal information and video by sending them to potential employer in order to inform the employer of the opportunity to hire the Job seekers.
 
Use of Personal information
 
Visa JobCanada will make its best to limit the access to the Job seeker’s personal information via its Web site to Employers and Recruiters having paid their access rights. By the acceptance of the Policy, Employers and Recruiters have the obligation not to reveal the Job seeker’s personal information that will be communicated to them to other persons outside their company. They are only allowed to reveal this type of information to those working within their company or, if necessary, to third parties like an Employer from which they will have received a recruitment mandate. For that purpose, an agreement must beforehand have intervened between the Recruiter and the third parties requiring him to use the personal information collect and, or the résumé of the Job seeker solely for the purpose to provide an employment in its company and not to divulge these personal information collect or the résumé and video of the Job seeker to any person outside his company. Notwithstanding the fact that Visa JobCanada will make its best to deal with reputable Employers and Recruiters, Visa JobCanada cannot guarantee, for and in the names of these Employers and these Recruiters, that they will adhere to the limitations imposed by these agreements. 
 
 
Visa JobCanada commits not to divulge the Job seeker’s personal information and video, such as demographic profile or information on the use of its Web site (hereafter: "Information") to any person other then Employers and Recruiters (hereafter: "Third parties"). All reasonable means will be taken to assure that the Information related to the Job seeker will not be used by Third parties for other purposes than those described in the Policy. However, the interpretation of the present policy must not be considered as a guarantee given by Visa JobCanada to the effect that no Third parties will obtain the access to the Information by diversion of the security systems, or by the lack of diligence on behalf of the Job seeker, notably by the disclosure of its password. Consequently, the Job seeker consents by the present policy to the fact that Visa JobCanada does not accept the liability for the use of the provided Information by the Third parties. 
 
Despite of the previous paragraph, the Job seeker authorizes, in the following circumstances, Visa JobCanada to reveal Information to Third parties, namely:
 
1. in the normal course of its business, to its suppliers notably, without limitation, as for the accommodation of its Web server, to the maintenance and technical support and to the security of its Web site. These suppliers will have access if necessary to the Information to execute the tasks falling to them without being able to share them with any other person. Notwithstanding that Visa JobCanada will make its best to use reputable supplier's services, these suppliers can have policies and practices concerning the protection of the personal information that diverge from those of EstrieEmploi.ca. Consequently, Visa JobCanada cannot guarantee, for and in the name of these last ones, that they will adhere to the limitations imposed by the inherent laws concerning the use of the personal information. However, Visa JobCanada is committed to examine the policies of protection of the personal information of these suppliers to understand their procedures of collect, use, communication and conservation of the personal information.
 
2. when the law or a governmental entity having authority requires Visa JobCanada to conform to legal demands, to prevent the commission of a criminal act or to protect the national security, the personal security of the Job seeker or the public in general.
 
Disclosure of Personal Information
 
We may disclose your personal information if we are required to do so by law or in the good faith belief that such action is necessary or appropriate to: (a) conform to or comply with any law, regulation or court order; (b) protect and defend our rights or property or that of our suppliers and licensors, whether or not we are required to do so by law; or (c) protect the personal safety of users of our web site or the public. The Job seeker can decline cookies. Use of electronic images
 
Visa JobCanada Web pages may contain electronic images known as Web beacons or single-pixel (gifs). Web beacons collect only a limited set of information including a cookie number, time and date of a page view by a Job seeker. Web beacons are use to compile aggregated statistics about Visa JobCanada Web site usage, Job seekers or visitors who have visited Visa JobCanada Web pages but they cannot supply information to identify a person visiting the company Web site.
 
Use of information for purpose of improvement
 
Visa JobCanada uses the Job seeker’s personal, demographic, collective or technical information collected via the Web site in order to improve and administer its Web site and to present its products and services in a more effective way for the Job seekers. Visa JobCanada may also use the information gathered to inform the Job seeker of other products or services available, to contact the Job seeker about his opinion or to advise him on the updates of the Web site.
  
 
From the registration of the Job seeker, the personal information will be kept by Visa JobCanada in an electronic Account until the THIRTHIETH (30e) day following the deletion of personal information in an archival copy.
 
Security
 
Visa JobCanada commits to maintain implemented reasonable technical and organizational measures to secure the Job seeker personal information available via Visa JobCanada Web site, notably by using key words and passwords from accidental loss, theft, access, use, modification, copy or disclosure them without authorization. If the Job seeker sends an E-mail to EstrieEmploi.ca, these methods of security will not be used. 
 
By the present commitment of security, Visa JobCanada cannot guarantee to the Job seeker that an unauthorized Third party will never be able to pass over these measures of security or use the personal information for improper purposes, by hostility or by the lack of diligence of the Job seeker, notably by the disclosure of his password.
 
Visa JobCanada instructs its employees, with access to Job seeker personal information, that it is to be used in adherence with the principles set forth in this Policy concerning the personal information and the applicable laws.
 
GEnEral dispositions
 
Modification of the Policy
 
The top of the Policy indicates the date that it was updated last. Visa JobCanada reserves the right to modify or improve at all time this Policy or to change it for a new one (: “Modification of the Policy”). The Job seeker may read any such notice of modification of the new Policy statement. If the Policy is modified, a notice will be posted on Visa JobCanada home page for a period of thirty (30) days, with a link to the updated Policy. If the Job seeker continues using the Web site after Visa JobCanada has posted such notice of thirty (30) days on its home page, it will constitute his acceptance of the new terms and their application of the Policy as if they were the initial terms, and the personal information related to the Job seeker, previously furnished to the Modification of the Policy, will be deemed to have been collected, used, communicated and conserved according to the new Policy. However, Visa JobCanada commits to ask the Job seeker’s consent if Visa JobCanada wants to use his personal information for purpose and objectives other than those agreed previously.
 
Minor
 
In Accordance with the article 156 of the Civil code of Quebec, L.Q. 1991 c.64, a minor of fourteen (14) years old or over can act alone for all related acts to his employment. Consequently, he can consent to the Policy and register as a Job seeker on the Web site of EstrieEmploi.ca. However, a minor under fourteen (14) years old has no capacity to consent to the Policy. If a minor of less of fourteen (14) years old registers as a Job seeker, Visa JobCanada cannot be held responsible for any loss or for any damages who could have derived from the use of its Web site and, or, personal information collected, used, communicated and conserved related to the minor of less than fourteen (14) years old who registered as a Job seeker.
